The EB-5 Visa and Regional Center

In 1990 the U.S. Congress created the “Immigrant Investor Program”, also known as “EB-5”, in order to stimulate job-creation and investment in the United States. Under the program, foreign investors and entrepreneurs invest in new job-creating enterprises in the United States, and in exchange receive expedited permanent resident immigration status. The EB-5 program allocates 10,000 immigrant visas per year to qualified foreign investors seeking permanent resident status on the basis of their investment in a new commercial enterprise.

A Regional Center is a private enterprise or regional governmental agency seeking to promote economic growth, regional productivity, job creation and capital investment in a certain geographic region. The U.S. Regional Center program is similar to long-standing and successful investment-employment programs in other developed nations, such as Australia, Canada, and the U.K., among others.

The Regional Center Investment Program requires 10 permanent jobs to be created, directly or indirectly, by the foreign investor’s enterprise. The Regional Center, working with numerous investors, helps foreign investors by managing and professionally overseeing their investment in the designated business and geographic region, and ensuring that the employment requirement is met at all times.

In order to qualify for an EB-5 Green Card through the Regional Center program, a foreign investor must make an investment of at least $1 million and prove that at least 10 jobs were directly or indirectly created in the process. Instead of $1 million, a smaller investment of $500,000 is required in some rural, high unemployment or Targeted Employment Areas (TEA).

By making the investment through a Regional Center, foreign investors entrust the day to day management of their investment to the Regional Center, and are therefore able to continue with their preexisting businesses or projects.

Similar to the ordinary EB-5 program, investors participating through a Regional Center will initially receive a provisional Green Card, which will be valid for two years.  

Ninety days prior to the expiration of the provisional 2-year Green Card, the investor will file an additional application with the USCIS, petitioning to remove the Green Card’s conditional status (Form I-829). This application proves that the investor sustained the investment over the two year period, and that the requisite number of jobs was created. Once this application is approved, the conditions are removed from the EB-5 applicant’s status, allowing the investor, his spouse and unmarried children (under age 21 at the time of petition) to permanently live and work in the United States.

Once the I-829 petition to remove conditions is approved, the investor and his immediate family members obtain permanent resident status and can later apply for U.S. citizenship. In whole, the EB-5 process takes approximately 3-5 years or longer. The length of the process is contingent on quality and timeliness of the investor's applications.
